DMCA and Copyright Policy

Noti Group respects the intellectual property of others and expects the same of everyone who uses the site. We respond to notices of alleged copyright infringement that comply with the United States Digital Millennium Copyright Act ("DMCA", 17 U.S.C. § 512) and with equivalent laws in other countries, and we remove or disable access to infringing material when appropriate.

How to report infringement

If you believe that material on https://noti.group infringes a copyright that you own or are authorized to act for, send a written notice to our designated copyright agent (contact details below) that includes:

  1. your physical or electronic signature, as the copyright owner or a person authorized to act on the owner's behalf;
  2. identification of the copyrighted work you claim has been infringed (or, if several works are covered by one notice, a representative list of them);
  3. identification of the material you claim is infringing and that you want removed, with information reasonably sufficient for us to locate it, such as the exact address (URL) of each page;
  4. your contact information: name, postal address, telephone number and email address;
  5. a statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent or the law;
  6. a statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on the owner's behalf.

Notices that do not include this information may not be valid, and we may not be able to act on them. Before sending a notice, please consider whether the use may be a lawful use, such as a short quotation for news reporting, commentary or criticism.

What we do when we receive a notice

When we receive a valid notice we act expeditiously to remove or disable access to the material, we notify the person who provided it where possible, and we keep a record of the notice. We may forward a copy of the notice, including your contact details, to the person who provided the material.

Counter-notice

If material you provided was removed and you believe it was removed by mistake or misidentification, or that you have the right to use it, you may send a counter-notice to our copyright agent that includes:

  1. your physical or electronic signature;
  2. identification of the material that was removed or disabled and the address where it appeared before;
  3. a statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
  4. your name, postal address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if your address is outside the United States, any judicial district in which Noti Group may be found), and that you will accept service of process from the person who sent the original notice or their agent.

When we receive a valid counter-notice, we send a copy to the person who sent the original notice. Unless they inform us within 10 business days that they have filed a court action to restrain the activity, we may restore the material between 10 and 14 business days after receiving the counter-notice.

Misrepresentation

Under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and legal fees. If you are not sure whether material infringes your rights, please seek legal advice before sending a notice.

Repeat infringers

In appropriate circumstances, and at our discretion, we will terminate the access of contributors and other users who repeatedly infringe the copyrights of others.
